A New Accreditation Scheme for Safety Consultants

HSE will officially announce the new accreditation scheme for safety consultants in the UK very soon. It was a joint initiative of many health and safety groups headed by Geoffrey Podger, Chief Executive of the HSE. The objective is to improve the existing methods of safety advice used by experts for guiding employers. The scheme is still under preliminary stage, and they will issue a joint statement in late summer after finalization of the plan.

The scheme is only for consultants, who are in charge of conventional safety methods, and does not cover issues related to occupational hazards. It is however, not a compulsory scheme. The members will have to pay a fee to cover administrative expenditure. The register will be openly accessible to all through a website. It has received a positive response from safety experts and companies.

IOSH is one of the safety groups, which actively participated in the project. Its Chief Executive, Rob Strange, stressed on its necessity and supported Lord Young’s view that the incompetent safety experts had brought stagnancy in the system. He also felt that such a trend is dangerous for the safety of workers.

The experts will play a positive role in improving the conditions at workplace, and this is going to benefit both big as well as small companies. It will remove the flaws in healthy and safety initiatives by bringing qualified, knowledgeable, and efficient safety consultants. Employers requiring support on safety issues do not have to search for them anymore. Overall, it will build trust between workers and safety consultants.

Charities Not Paying Minimum Wages to Workers

The Working Time Regulations 1998 suggest that if workers are required to do ’sleep-ins’ while they are still at the disposal of their employer, this will amount as working time. During this ’sleep-in’ time, the worker can be called for work anytime when the employer needs anything done. In such a case, the worker is qualified for the National Minimum Wage at the current rate of £5.80 an hour as the workers’ union Unite recently suggested. Organisations that are not paying minimum wages are violating the law by doing so.

According to Rachael Maskell, National Officer, Not for Profit Sector, many organisations seem to have ignored this completely. If the organisations do not pay minimum wages for these work hours, the worker is eligible to bring a claim for deduction of wages against the organisation. A case was brought before the Employment Appeal Tribunal in December 2009 regarding the payment of wages for the time spent during sleep-ins in a residential care home. The tribunal held that the employer has to consider this while calculating wages.

The organisations have followed many routes to avoid payment of wages in such situations. For example, in a Scottish mental health charity, workers are paid for sleep-ins but they are not paid if they have to get up and do something for the residents. Instead, they are given time off later.

As she clearly said, it amounts to violating the law and there are about 170,000 charities in the country that are doing the same.

Rebecca McGuirk, a partner at law firm Shoosmiths, has however warned that it is important that the tribunal look at these cases one by one, depending on their facts, as these cases rely on facts.
